We also track Canada Hemp Laws and where it’s legal to grow hemp in 2020 and hemp production is allowed on the following provincial Alberta Hemp, Saskatchewan Hemp, Ontario Hemp and Manitoba Hemp in Canada.

The "New Varieties" are varieties or strains designated as NEW in the table below have been approved for entry into that State's Hemp Program based on an out-of-state certificate of analysis, but the variety has not yet been grown or tested in that State yet.

The “Prohibited Variety” means a variety or strain of cannabis excluded from that State’s Program.

The “Variety of Concern” means any variety of hemp in the State's Program that tests above 0.3000% delta-9-THC in one (1) or more Pre-Harvest Samples. “Variety of Concern” may be subject to proof of Analysis by the vendor.

NOTE: Since our Certificate of Analysis show it's less than 0.3000% delta-9-THC, on any of our strains, that are listed is NOT of Concern.

Growers faced many challenges the first year of producing industrial hemp in the State. The California Industrial Hemp Farming Act (Senate Bill 566, Chapter 398, Statutes of 2013) was signed into law to authorize the commercial production of industrial hemp in California. The Act became effective on January 1, 2017, due to a provision in the Adult Use of Marijuana Act (Proposition 64, November 2016).

As directed by this Act, the California Department of Food and Agriculture (CDFA) is developing a program to administer this new law. The first step of this process is establish an Industrial Hemp Advisory Board. With assistance from the Board, CDFA will further develop the registration process, fee structure, regulations, and other administrative details as necessary to provide for the commercial production of industrial hemp in accordance with the Act.

The Colorado Department of Agriculture Industrial Hemp Program will continue to operate as is, under the 2014 Farm Bill, until the USDA approved state plan is adopted November 1, 2020. Industrial hemp means a plant of the genus Cannabis and any part of the plant, whether growing or not, containing a delta-9 tetrahydrocannabinol (THC) concentration of no more than three-tenths of one percent (0.3%) on a dry weight basis.

Under State and Federal law, the CDA tests for total THC through the process of post-decarboxylation. The Colorado Department of Agriculture’s Industrial Hemp Program regulates only the cultivation of industrial hemp. The Department also administers a certified seed program. The Industrial Hemp Program does not have jurisdiction over the processing, sale or distribution of industrial hemp.

Public Act 19-3, An Act Concerning A Pilot Program for Hemp, signed by Governor Lamont, authorizes the Connecticut Department of Agriculture (DoAg) to implement a Hemp research program. The Public Act also authorizes DoAg to submit a state plan to the United States Secretary of Agriculture. Once the State Plan is approved by USDA the research program will expire and DoAg will regulate the commercial production of Hemp as an agricultural commodity in conformance with the 2018 Agriculture Improvement Act and the Connecticut Public Act Concerning A Pilot Program for Hemp.

Hawaii Department of Agriculture’s industrial hemp pilot program regulates only the cultivation of industrial hemp. It does not regulate the processing of industrial hemp or products made from or containing industrial hemp. The pilot program places no restrictions on cultivating industrial hemp containing cannabidiol (CBD). However, there may be other laws or regulations that restrict or prohibit CBD in hemp, both during cultivation and after harvest. Cannabis business organizations licensed by the Illinois Department of Agriculture for cultivation, growing, processing, manufacturing, and/or infusing of medical and/or adult-use cannabis products pursuant to the Cannabis Regulation and Tax Act and/or the Compassionate Use of Medicinal Cannabis Program Act may use industrial hemp as an ingredient in cannabis infused products offered for sale at licensed dispensaries in Illinois. The Kansas Department of Agriculture (April 16, 2020) proposed Kansas Administrative Rules and Regulations to regulate a Commercial Industrial Hemp Program. and submitted a plan to USDA-AMS for inclusion into the U.S. Domestic Hemp Production Program in January 2020. KDA received program approval from the USDA on April 16, 2020, but will continue to operate under the Industrial Hemp Research Program until the formal approval and adoption of the state’s regulations occur and the Commercial Industrial Hemp Program is established.

The Kentucky Department of Agriculture (KDA) is conducting a Hemp Licensing Program as authorized by state and federal laws. No person can grow, handle, broker, or process hemp in Kentucky without a license issued by the KDA.

Kentucky’s program has experienced tremendous growth in just a few short years. In the first year of the program, farmers planted 33 acres and succeeded with a modest harvest. In 2015, over 900 acres were planted and about 500 were successfully harvested. In 2016 we had reports of over 2,300 acres planted and about 2,000 acres harvested. The 2017 growing season saw another increase in hemp acreage in Kentucky with more than 3,200 acres planted. In 2018, licensed growers planted 6,700 acres and harvested about 6,000 acres. In 2019, Kentucky farmers planted more than 26,500 acres of hemp and are having difficulty finding a market for the expanded production.

The purpose of the Maryland Industrial Hemp Research Pilot Program is to register industrial hemp growing sites and facilitate the research of industrial hemp in any aspect of growing, cultivating, harvesting, processing, manufacturing, transporting, marketing, or selling industrial hemp for agricultural, industrial, or commercial purposes.

This program requires farmers partner with institutes of higher education or the Maryland Department of Agriculture to grow industrial hemp under a research program. ​Farmers will be allowed to sell their crop for profit at the end of the growing season. The Michigan Industrial Hemp Research and Development Act, Public Act 641 of 2018 became effective on January 15, 2019. Among other things, PA 641 establishes a licensing program for persons engaged in the growing, processing and handling of industrial hemp. Michigan State University has made a PDF guide called Industrial Hemp Production in Michigan.

Under PA 641, anyone who grows industrial hemp or processes, handles, brokers, or markets industrial hemp in Michigan, must obtain a registration or license from MDARD. Persons who obtain the appropriate registration or license will be able to grow, process, handle, broker, or market industrial hemp in conformance with Michigan law, however; because MDARD’s industrial hemp program has not yet been approved by USDA, a registration or license issued under PA 641 is not sufficient for a grower or processor-handler to conform to federal law. In order to be in conformance with both state and federal law, participation in an Ag Pilot Program is required.

The Minnesota Hemp Research Pilot Program studies the growth, cultivation, and marketing of hemp. To better learn about hemp in Minnesota, pilot participants are required to provide reports to the MDA regarding seed varieties planted, agronomic findings, and any processing, distribution and sales of products. The pilot program has been administered by the MDA since 2016.

The MDA hosted three listening session around the state in November 2019 to gather input on Minnesota’s Industrial Hemp Program.

The NDA exists to support farmers’ interests and encourages a sustainable commodity that can benefit the Nevada economy in any sector. The NDA commitment to the industrial hemp program is strictly one of oversight and enforcement of all state and federal regulations. The New Jersey Hemp Farming Act was enacted in August 2019. This new legislation complies with the 2018 Farm Bill, which authorized hemp producers to grow and sell hemp for commercial purposes. On December 27, 2019 New Jersey was among the first three states to have its Hemp Program approved by the USDA. It is the participant’s responsibility to ensure that the transfer or sale of any hemp material complies with all applicable state and federal laws. All hemp materials must be appropriately identified or labeled during transit.

Until further notice, North Carolina will continue to operate under the Industrial Hemp Pilot Program authorized in 2014. Hemp production has been legalized in North Carolina, but only as part of the state’s pilot program as allowed under federal law. The N.C. General Assembly passed Senate Bill 313 in 2015, allowing the Industrial Hemp Commission to develop the rules and licensing structure necessary to stay within federal laws. The law was modified in 2016 in House Bill 992. The Industrial Hemp Commission adopted temporary rules for review in February 2017; these were approved by the Rules Review Commission of the Office of Administrative Hearings.

North Dakota Hemp Program along with the United States Department of Agriculture (USDA) recently released the Interim Final Rule for the Hemp Program. North Dakota Department of Agriculture (NDDA) recommends that anyone interested in the hemp program. USDA took comments till January 29th, 2020.

The Oklahoma legislature passed the Oklahoma Agricultural Industrial Hemp Pilot Program (OAIHPP) Guide (PDF here) in April of 2018 and the temporary rules to govern the program were adopted by the Department in May of 2018.

Under the laws and rules for the OAIHPP program, a farmer wishing to grow industrial hemp must establish a relationship with a University or college that belongs to the Oklahoma State System of Higher Education and has a plant science curriculum.

Once the farmer has a relationship with a University or College they can apply to the Department to receive a license for each cultivation site. By law, industrial hemp must have less than 0.3% THC. THC is the chemical that produces the euphoric effect or “high” of other cannabis plants.

The Oregon Department of Agriculture’s Hemp Program provides another opportunity for Oregon agriculture to grow industrial hemp. Hemp means all non-seed parts and varieties of the Cannabis plant, whether growing or not, that contain an average tetrahydrocannabinol concentration that does not exceed 0.3 percent on a dry weight basis. The 2020 season will be the fourth year that hemp will be grown in Pennsylvania Industrial Hemp Program. Since the program’s modest start in 2017, with the issuance of 14 hemp research permits issued and 36 acres grown under the authority of Pennsylvania’s Industrial Hemp Research Act of Jul. 20, 2016, P.L. 822, No. 92 and legitimized by the 2014 Farm Bill, hemp has seen a major increase in the commonwealth.

In 2019, the cap on both number of hemp permits and amount of acreage per permit were removed, and the Department issued 324 growing permits for farms which planted just over 4,000 acres of hemp. In 2020, the Department is committed to continuing to foster the conditions for Pennsylvanians to grow a profitable, sustainable, and in-demand hemp product.​

Hemp is a variety of the plant Cannabis sativa that is low in the chemical THC. Here’s the definition under South Carolina state law: ‘Hemp’ or ‘industrial hemp’ means the plant Cannabis sativa L. and any part of that plant, including the non-sterilized seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with the federally defined THC level for hemp.

Hemp farming is currently legal in South Dakota. However, no plan has been established yet at this time.

On April 1, 2020 – South Dakota Gov. Kristi Noem has signed into law a bill legalizing industrial hemp and CBD oil. The 2018 Farm Bill made the production, processing and distribution of hemp federally legal; however, South Dakota, Idaho and Mississippi were the only states to keep hemp production illegal.

House Bill 1008 legalizes the growth, production and transportation of industrial hemp in the state. The use or sale of smokable hemp is prohibited.

The bill includes $3.5 million in funding to establish the state’s hemp production program. Funding may change after a special session is held in June to review the state’s budget.

The state’s hemp plan will have to be submitted to and receive approval from the U.S. Department of Agriculture before growers can start planting.

The cultivation of industrial hemp is now available as an option for Tennessee farmers on a limited basis. The Commissioner of the Tennessee Department of Agriculture has promulgated regulations establishing a program of licensing authorized hemp producers.

Legitimacy of Industrial Hemp Research contained in the 2014 Federal Farm Bill, which was signed into law Feb. 7, provides for the cultivation of industrial hemp for purposes of research by institutions of higher education or state departments of agriculture in states where it is legal. The interaction of the U.S. Drug Enforcement Agency (DEA) and the provisions of Sec. 7606 is a developing process.

As TDA develops Tennessee’s industrial hemp program every effort will be made to minimize the impact of federal law on potential hemp producers in Tennessee.

Texas Agriculture Commissioner Sid Miller is a strong supporter of industrial hemp production as a new market opportunity for Texas farmers to expand their operations and grow alternative crops.

The 2018 Farm Bill legalized the commercial production of hemp and authorized states to submit state plans to administer hemp programs. On June 10, 2019, House Bill 1325, was signed into law by Governor Greg Abbott. The bill authorizes the production, manufacture, retail sale, and inspection of industrial hemp crops and products in Texas. This also includes products for consumable hemp products which contain cannabidiol (CBD), as well as other edible parts of the hemp plant.

The TDA submitted the state hemp plan to USDA on December 2, 2019 and it was approved by the USDA on January 27, 2020. Administrative rules were published in January 2020 and became effective in the Texas Department of Agriculture on March 11, 2020. The State of Vermont Agency of Agriculture, Food and Markets (AAFM) effective May 21, 2020 under 6 V.S.A., chapter 34 has adopt rules establishing how the AAFM will conduct research within its hemp program and the requirements for the registration of hemp growers and processors. These rules also address standards and expectations for record keeping, reporting, testing, and labeling, and include enforcement provisions.

In Vermont, Industrial hemp or hemp is the Cannabis sativa L. plant is considered an “agricultural product” when grown by an individual that is registered with Vermont Agency of Agriculture, Food & Markets (the “Agency”) as part of its pilot program. For the 2020 Hemp Growing Season In the State of Virginia will be on Oct. 31, 2020, Virginia Department of Agriculture and Consumer Services (VDACS) will administer a 2014 federal Farm Bill hemp program. A Registered Industrial Hemp Grower must submit a Hemp Planting and Propagation Report (see below) within 14 calendar days of planting seeds, clones, or cuttings. Washington State Department of Agriculture launched the Washington State Hemp Program, WSDA Hemp Program Guide (PDF). The rules will be effective January 1, 2020 the department has authority to regulate licensees, process license applications or conduct hemp inspections. Licenses will expire on the last day of April following the year the license is issued. For example, if a producer applies for a license February 1, 2020, and is granted a license on March 1, 2020, the license would expire April 30, 2021. Washington Approved Hemp Seed Varieties: Not Published | WSDA FAQ – Where Can I Purchase Hemp Seed – You can purchase seed from whoever and wherever you like, including any state and internationally. WSDA asks that you provide the source of the seed, the opportunity to do so is provided in the Hemp Production License Application and the Hemp Harvest Inspection/Sampling request. WSDA does not require certified seed for planting Hemp, meaning the seed can be certified or not certified, both are allowed in the current program.

Since the inception of West Virginia Department of Agriculture Hemp Pilot Program, interest and investment in industrial hemp in West Virginia has grown exponentially.

From 2017 to 2019, the number of license-holders increased from 46 to 165, and the acreage registered with the program recorded a corresponding increase, quadrupling to 641 planted acres over the same time frame. For the 2020 growing season, WVDA received 456 applications to grow and/or process hemp.

WVDA’s current regulations and practices under its pilot program are very similar to those required by the Interim Final Rule for an Effective Date of October 31, 2020. This means that West Virginia is well positioned to make a smooth transition into operating under a USDA-approved hemp plan. This document is an outline of the West Virginia Department of Agriculture’s Industrial Hemp Program and is WVDA’s formal submission to the USDA for review and approval. The Wisconsin Department of Agriculture, Trade and Consumer Protection’s hemp pilot research program requires both hemp growers and processors to obtain one-time licenses, and register each year they intend to plant/process hemp. The United States Department of Agriculture (USDA) has approved the Wyoming hemp regulatory plan and has granted authority to the Wyoming Department of Agriculture (WDA) to regulate the hemp industry in Wyoming. The WDA resubmitted the Wyoming hemp plan on January 31, 2020 after USDA issued the Domestic Hemp Production Program interim final rule late last year.

Upon USDA’s approval of the Wyoming hemp plan on February 20, 2020, the WDA will now have primary regulatory responsibility for hemp growing and processing in the State of Wyoming. Hemp in Wyoming Guide (PDF)

Growing Hemp Biomass, Hemp Seeds and Hemp Seedlings in U.S. Virgin Islands

On May 22nd, 2020, U.S. Department of Agriculture has approved the US Virgin Islands Hemp Plan and Four Indian Tribes. USDA also signed off on plans from the Cheyenne River Sioux Tribe, Chippewa Cree Tribe, Lac Courte Oreilles Band of Lake Superior Chippewa Indians and Red Lake Band of Chippewa Indians.

V.I. Department of Agriculture and Industrial Hemp Commission, includes provisions for maintaining information on the land where hemp is produced, testing the level of delta-9 tetrahydrocannabinol (THC), disposing of plants that do not meet the necessary licensing and other requirements, and ensuring compliance with all USDA and other federal guidelines. The Virgin Islands Hemp Plan also contains provisions governing the University of the Virgin Islands’ research and testing of hemp and hemp products.
